Should parties be allowed to
exchange views with their
appointed arbitrators regarding
the selection of the chair?
The survey confirms that communication
between a party and its appointed arbitrator
with respect to the choice of the chair
is generally perceived to be appropriate.
Almost three-quarters of respondents (74%)
believe that party-appointed arbitrators
should be allowed to exchange views with
their appointing party regarding the selection
of the chair. More Western European and
North American respondents (80% and 79%,
respectively) than Asian and Latin American
respondents (60% and 61%, respectively)
consider this practice appropriate.
